Terms and Conditions

Welcome to Luxuria London Ltd.

These conditions shall apply to all contracts unless expressly varied in writing by the seller. Any inconsistencies to the company’s terms, offered on behalf of the consumer shall be assumed to be void unless accepted by the company, in writing.

Payment of deposit, or email confirmation is deemed to be acceptance of the contract as set out in these terms and conditions.
These terms and conditions supersede all previous conditions of sale.

1. Orders
a) All quotes whether written or verbal are valid for 30 days. Orders will be accepted and dealt with by payment made upon Pro-forma Invoicing.
b) Once the order is activated materials are ordered and work can commence at any time. Cancellation may not be possible from this point. Changes may be possible but may incur extra
charges.
c) We reserve the right without prior notice to discontinue or change specifications and prices on products, programs and services offered on this web site without incurring any obligations
(although changes to specifications and pricing will not affect orders placed prior to the change).
2. Payment
a) A 50% deposit is required before the order can be processed. Full balance must be paid in cleared funds prior to the scheduled delivery or collection date.
b) Credit card companies charge the us a fee when the buyer makes payment and therefore a credit card fee is applied by the us to products purchased by credit card.
c) Orders for export outside the EU require proof of shipment, which is the buyer’s responsibility to provide us. If this is not provided within 1 calendar month of delivery or collection, the seller will invoice the buyer for the VAT amount, which will become payable immediately

3. Delivery and Collection
a) Whilst we will use our reasonable endeavours to deliver the goods in the timescale advised to you, unexpected delays may occur in the supply chain and therefore we cannot guarantee that
this timescale will be met and do not accept liability for any such delay.
b) When the Goods are ready for delivery, we will contact you to arrange a delivery date. We normally expect that within 72 hours of us notifying you that the Goods are ready for delivery, you
will agree with us a delivery date
c) We will use our reasonable endeavours to deliver the Goods on the agreed date or such later date as you may subsequently request and we agree to, but we will not be liable for any loss or
damage of any kind caused either directly or indirectly by any delay in meeting delivery dates and nor will you be entitled to repudiate the contract and reject the Goods due to delay in delivery d) The Goods will be placed in the room you have selected, unpacked and the packaging removed from site. However, the Goods will not be placed in the specified room if this is not feasible due to difficulties of access or if the room has not been cleared to allow sufficient space for the Goods to
be manoeuvred into and placed there
e) The dimensions of the Goods are quoted in our sales literature in all published formats but are a guide only as there can be minor variations in the dimensions of the finished goods. If you are in any doubt as to whether access is going to be adequate, we advise you to make an Access Request.
f) Any damage to your property caused by the delivery team is to be reported to us within 12 hours of delivery. We cannot consider claims made outside this period
g) If delivery cannot be achieved due to inadequate access or due to you or your authorised representative being in attendance but refusing delivery for any reason or if there is no one in
attendance to accept delivery, or if delivery costs arise that you do not pay then the Goods will be returned to the warehouse and stored and you will incur an additional charge in respect of the failed delivery equal to 15% of the price of those Goods that have not been delivered.

4.Bespoke
a) Bespoke Items are manufactured to be within reasonable commercial standards of tolerances for goods of their type and there can be minor variations in the dimensions of the finished goods as compared to any dimensions given in sales literature
b) Variations may occur in the colour and tones of materials, particularly in solid wood and veneered products or different materials, and may occur due to the composition of materials. The Company cannot guarantee the exact colour consistency throughout the range of materials used
c) If bespoke goods are delivered damaged or faulty or are otherwise incorrect, you must notify us within 24 hours of delivery and we will arrange to inspect the Goods and if they
are found to be damaged, faulty or incorrect we will repair or replace them as appropriate and arrange for the repaired or replaced Goods to be delivered to you at no additional
charge.
5.Returns / Cancellation
We will accept the cancellation of an order subject to the following conditions:
a) The Goods must not have been made to your specification or otherwise personalised to your requirements including Bespoke and Customised standard.
b) The Goods must have been delivered to an address within the United Kingdom
c) If you receive a damaged, defective, or incorrect item, we will work with you to make things right. If you change your mind about an item, your refund will be reduced by a restocking charge and you will be responsible for outbound and return shipping and delivery.
d) We do not accept any returns or exchanges on personalized orders, special orders, items sold on promotional sale, special offers, bespoke items or items stated as “sold as seen”
e) If you wish to cancel the order and have not seen the Goods in our showroom before placing your order, you must notify us of your wish to cancel no later than 5 days after
delivery in writing
f) Items that have been removed from the original packaging cannot be returned.
g) Your refund will be the price of the Goods less the cost of any standard delivery costs, additional delivery costs and Access Requests Inspection and Report costs.
h) If you cancel, you are obliged to take reasonable care of any Goods delivered to you, which must be kept in a never been used condition
i) If a fault is discovered after the goods have been exported out of the UK by the buyer, it is the buyer’s responsibility to return the goods to the UK at the buyers cost for inspection. If a repair or replacement is produced by the seller, it will only be delivered to a UK destination. If the buyer then wishes for the goods to be exported, it will be the buyer’s responsibility to do this at the buyer’s cost. For export orders, it is therefore recommended that inspection takes place in the UK prior to shipment.
j) We reserve the right of discretion, to accept/or refuse the return of any goods supplied.
k) We will only replace like for like, the buyer cannot change any of the sizes, fillings or
fabric.
6.Storage
a) Balance payment is due once manufacture is completed. The seller will offer storage for up to one calendar month following the completion of manufacture of your order, free of
charge. Thereafter the seller reserves the right to apply a discretionary charge for ongoing storage. This will be calculated at a rate of 2% of the total sold value of the
goods (Inclusive of VAT) per calendar month, and pro-rata for any days or weeks within a monthly cycle, up to the date of delivery.
7. Upholstered Materials
a) Balance payment is due once manufacture is completed. The seller will offer storage for up to one calendar month following the completion of manufacture of your order, free of charge. Thereafter the seller reserves the right to apply a discretionary charge for ongoing storage. This will be calculated at a rate of 2% of the total sold value of the goods (Inclusive of VAT) per calendar month, and pro-rata for any days or weeks within a monthly cycle, up to the date of delivery.

8. Trade Clients
a) You acknowledge that before placing your Order you represented and warranted to us that you are not insolvent and have not committed any act of bankruptcy, or, being a company with limited or unlimited liability, know of no circumstances which would entitle any debenture holder or creditor to appoint a receiver, to petition for your winding up or exercise any other rights over or against your assets.
b) Title in the Goods shall pass upon payment of the whole of the price of all the Goods in the Order (including any Interest accrued on the price) and until then all the Goods shall be and remain our sole and absolute property as legal and beneficial owner.
c) Until title passes you will be in possession of the goods solely as the bailee of the Company.
d) Goods supplied by us shall be at your sole risk as soon as they are delivered to the deliver address and it shall be your responsibility at your own cost to insure the Goods in their full reinstatement value against all usual risks and to properly keep them until title has passed
9. Liability
a) Without prejudice to condition 6.3 our liability for breach of contract shall not exceed the invoiced value of the Goods to which the Order relates and we shall not be liable for loss
of profits loss of revenues loss of anticipated profit loss of goodwill loss of amenity or use or any type of special indirect or consequential loss.
b) Without prejudice to condition 6.3 our liability for damage to property caused by negligence or otherwise shall not exceed [this should be your third party liability insurance limit of cover, or less if you prefer] and we shall not be liable for loss of profits loss of revenues loss of anticipated profit loss of goodwill loss of amenity or use or any type of special indirect or consequential loss.
c) If you are a consumer, nothing in these terms and conditions shall exclude or purport to exclude your statutory rights arising from dealing with us as a consumer.

10. Governing Law
a) These terms and conditions are governed by English law. By accepting them you agree to submit to the jurisdiction of the English courts in relation to any disputes arising in connection with these terms and conditions or the contract between us. We reserve the right to amend these conditions without warning.
